Accessibility Disclaimer

J.S. MediaDesign Inc. is committed to building and remediating websites that people of all abilities can use. This page explains what our accessibility services can and cannot promise, so every client knows exactly what to expect.

1. Our standard

We design, build, test and remediate websites to conform with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, using commercially reasonable efforts, industry standard tools and hands-on manual testing. Conformance applies to the pages, features and content we tested, as they existed on the date of testing.

2. Why no website can be 100% accessible to everyone

We do not guarantee that any website will be fully accessible to every person in every situation. No developer can honestly make that promise, for several reasons:

  • People and disabilities are different. A design that helps one person can be harder for another, and some needs conflict with each other.
  • Assistive technology varies. Screen readers, browsers, devices and settings all behave differently, and they change with every update.
  • WCAG is a technical standard, not a guarantee of usability. A site can meet WCAG 2.1 Level AA and still present challenges for some users.
  • Testing has limits. Automated tools find only part of the issues, and manual testing cannot cover every combination of device, browser and assistive technology.
  • Standards and laws evolve. New guidelines, court decisions and regulations may change what is expected over time.
  • Websites change. New content, menus, images, documents and updates can introduce new barriers after our work is complete.

3. Third-party platforms, plugins and content

We cannot guarantee the accessibility of anything we do not build or control, including:

  • Reservation, ordering, delivery and gift card platforms (for example OpenTable, Resy, Toast and similar services)
  • Embedded maps, videos, social media feeds, chat widgets and review widgets
  • WordPress themes, plugins and page builders created by other companies
  • Payment processors, booking engines and other hosted services
  • Documents, PDFs and media supplied by the client or other vendors

These products run their own code, which we cannot modify. We can test them, document barriers, recommend accessible alternatives, make the surrounding content accessible and report issues to the vendor. Their accessibility remains the responsibility of each provider.

4. Changes made after our work

Our work reflects the website at the time we complete and test it. We are not responsible for barriers introduced afterward by content updates, plugin or theme updates, platform changes, or edits made by the client or other parties, unless that work is covered by an active care plan, and then only within the scope of that plan.

5. No guarantee against legal claims

Accessibility work reduces risk, but we cannot guarantee that a business will not receive a demand letter, complaint or lawsuit. Plaintiffs and their attorneys decide whether to file claims, and courts decide their outcome.

6. Not legal advice

J.S. MediaDesign Inc. is not a law firm and does not provide legal advice. Nothing on this website or in our reports, statements or communications is legal advice. For questions about your legal obligations, or if you receive a demand letter, consult a qualified attorney. We are happy to work alongside your attorney on the technical side.

7. Our ongoing commitment

Specific terms for each project, including scope, warranties and limitations, are set out in our written client agreements, which take precedence over this page.
