Accessibility Results Disclaimer

This disclaimer explains what our accessibility audits, scans, reports and remediation work can and cannot do. Please read it carefully before relying on any accessibility result we provide.

01Who we are and what this covers

J.S. MediaDesign Inc., a Florida corporation ("J.S. MediaDesign," "we," "us" or "our"), provides website design, development, accessibility auditing, scanning, testing, remediation, monitoring and related consulting services.

This Accessibility Results Disclaimer applies to every accessibility result we provide, in any form, including audits, automated scans, free website snapshots, testing reports, remediation work, care plan monitoring, accessibility statements, conformance summaries, scores, emails, calls and any other communication about the accessibility of a website, web application, document or digital asset (together, "Accessibility Results").

03No guarantee of compliance or outcome

Web accessibility law is evolving, is applied differently by different courts, and for private businesses currently has no single technical regulation. We test against recognized technical standards, generally the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, which are guidelines and not law.

We do not represent, warrant or guarantee that any website, application or document is or will be fully accessible, "ADA compliant," compliant with any law or standard, or free of accessibility barriers. We do not guarantee that any Accessibility Result will prevent, defeat, reduce or resolve any demand letter, complaint, lawsuit, settlement demand, investigation or other claim, or influence the decision of any court, agency or opposing party.

04Results reflect a single point in time

Accessibility Results describe only the specific pages, screens, documents, features and versions we reviewed, on the dates we reviewed them, using the browsers, devices and assistive technologies identified in our report. Websites change constantly. New content, menus, images, promotions, plugins, theme or platform updates, and changes made by you or anyone else may introduce new barriers at any time, including immediately after our review. Results do not apply to any content created or changed after the review date.

05Limits of testing methods

We use a combination of automated tools and manual testing. Automated tools detect only a portion of accessibility issues and can produce false positives and false negatives. Manual testing is performed on a representative sample unless a written agreement states otherwise, and cannot reproduce every combination of disability, assistive technology, browser, device, operating system and user setting. As a result:

  • Pages, states or user flows not included in the defined scope were not tested.
  • Issues may exist that were not detected, identified or reported.
  • Any score, percentage, count or rating is a technical indicator only and is not a measure of legal compliance.

06Third-party content and platforms

Many websites rely on content, tools and code we do not control, including reservation, ordering, payment, booking, chat, map, video, social media and review widgets, embedded PDFs supplied by others, and website builders, templates, plugins and AI-generated code. We may identify barriers in these components, but we cannot change their code and are not responsible for their accessibility, their availability, or changes their providers make. Fixing them may require action by you or the third-party provider.

07Your responsibilities

You remain solely responsible for the accessibility of your website and digital assets and for your compliance with all applicable laws. This includes reviewing and approving all recommendations, implementing or authorizing fixes, maintaining accessibility as content changes, training your staff, ensuring that information you provide to us is accurate and complete, and obtaining legal advice where appropriate. Recommendations not implemented, implemented incorrectly or later undone by others are outside our responsibility.

08Free scans and snapshots

Free website snapshots, automated scans and preliminary reviews are general, high-level, informational overviews based primarily on automated testing of a limited number of pages. They are not audits, are not complete, and must not be relied on as evidence of accessibility, compliance or good faith. They are provided without charge and without any warranty or obligation.

09Reports, statements and documentation

Testing reports and conformance summaries document the work performed and the findings observed within the stated scope and dates. Accessibility statements we draft or publish for you are based on information you provide and on the state of the website at the time of drafting. You are responsible for reviewing them before publication and keeping them accurate. Documentation of remediation efforts may be useful to you and your counsel, but we make no representation about its legal effect or how any court, agency or party will treat it.

10No warranties

To the fullest extent permitted by law, Accessibility Results and all related services and content are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, title and non-infringement, and any warranty that results will meet your requirements or achieve any particular outcome.

11Limitation of liability

To the fullest extent permitted by law, J.S. MediaDesign will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, lost revenue, lost data, business interruption, legal fees, settlement payments, judgments, fines, penalties or remediation costs, arising out of or relating to Accessibility Results or our services, even if advised of the possibility of such damages.

12No personal liability

All services are provided solely by J.S. MediaDesign Inc. as a corporation. To the fullest extent permitted by law, no owner, officer, director, shareholder, employee, contractor or agent of J.S. MediaDesign Inc., including its founder Jana Schreiber, will have any personal liability for Accessibility Results or services, and you agree to bring any claim only against J.S. MediaDesign Inc.

13Written agreements control

If you have a signed proposal, statement of work, care plan agreement or other written contract with J.S. MediaDesign, that agreement defines the scope of the services and controls if it conflicts with this disclaimer. Where the agreement is silent, this disclaimer applies. Nothing on our website or in any conversation expands our obligations beyond what is stated in writing.

14Governing law and venue

This disclaimer is governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute arising out of or relating to Accessibility Results or our services will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts. If any part of this disclaimer is found unenforceable, the remaining parts remain in full effect and the unenforceable part will be enforced to the maximum extent permitted.

15Changes and contact

We may update this disclaimer at any time by posting a revised version on this page with a new effective date. The version in effect on the date of a service applies to that service unless a written agreement says otherwise.
